[UK] CitySprint loses third workers status tribunal

The Independent Workers’ Union of Great Britain (IWGB) has asked the government to do a better job of enforcing employment status laws after the union took CitySprint to tribunal on three occasions for denying workers their basic protections. The IWGB won its case against CitySprint after arguing that five couriers were misclassified as independent contractors, rather than workers and are thus entitled to holiday pay.

Despite a 2017 ruling against the company, reportedly calling their contractual arrangements “indecipherable”, CitySprint issued new contracts. IWGB then launched a second case in 2019 successfully proving that, even on the altered contracts, the workers were entitled to TUPE protections. The employment tribunal this week ruled that couriers were workers both before and after the change of contracts. Personnel Today reports the story with responses from both sides.
